Terms of Service — ViralFarm

These Terms of Service ("Terms") govern your access to and use of the ViralFarm website at myviral.farm and all related services, tools, and APIs (collectively, the "Service") provided by ViralFarm ("ViralFarm," "we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

You may register using Google OAuth or email/password.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must provide accurate, current, and complete information and keep it updated.
You must notify us immediately at myviral.farm@gmail.com if you suspect unauthorized access to your account.
We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

3. The Service

ViralFarm provides tools for:

Creating visual content (carousels, slideshows, pins, quote cards, infographics, and more) using AI assistance and customizable templates.
Exporting content as images, PDFs, or video.
Scheduling and publishing content to connected third-party social media platforms (including Instagram, Facebook, Threads, LinkedIn, TikTok, Pinterest, X, YouTube, Bluesky, and Google Business Profile) via third-party APIs.

We may modify, update, or discontinue features of the Service at any time. We will make reasonable efforts to notify you of material changes.

4. Connected Social Media Accounts

4.1 Authorization

When you connect a third-party social media account to the Service, you authorize ViralFarm to access that account on your behalf to publish, schedule, and manage content as you direct. You grant ViralFarm only the permissions necessary to provide these features.

4.2 Platform Compliance

You are responsible for ensuring that any content you create, schedule, or publish through the Service complies with the terms of service, community guidelines, and content policies of each social media platform. ViralFarm is not responsible for content you publish or for any actions taken by platforms against your account.

4.3 Revoking Access

You may disconnect any social media account at any time from your ViralFarm account settings. You may also revoke access from the third-party platform's own settings. Upon disconnection, we will delete stored OAuth tokens for that account within 24 hours.

4.4 Platform Data Use

Data obtained from third-party platforms is used solely to provide the Service (publishing and scheduling content you create). We do not use platform data for advertising, data mining, user profiling, building competing products or services, or any purpose unrelated to providing the Service. Data from one platform is never combined with data from another platform or used to develop functionality that competes with the originating platform. Our use of data from each platform complies with the respective platform's developer terms and API policies. Video content uploaded for TikTok publishing is not retained on our servers after successful transmission to the platform. ViralFarm does not cache, store, or archive TikTok video content or user metadata beyond the transient period required to complete a user-initiated upload.

5. User Content

5.1 Ownership

You retain all ownership rights to content you create or upload through the Service ("User Content"). ViralFarm does not claim ownership of your User Content.

5.2 License to ViralFarm

By using the Service, you grant ViralFarm a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and transmit your User Content solely for the purpose of providing the Service (e.g., rendering previews, exporting files, publishing to social platforms). This license terminates when you delete your content or your account.

5.3 Prohibited Content

You agree not to create, upload, or publish content that:

Violates any applicable law or regulation.
Infringes the intellectual property, privacy, or other rights of any third party.
Contains malware, viruses, or harmful code.
Is fraudulent, deceptive, or misleading.
Promotes violence, discrimination, harassment, or hate speech.
Contains sexually explicit material involving minors.
Violates the content policies of any connected social media platform.

We reserve the right to remove content that violates these Terms and to suspend or terminate accounts that repeatedly violate them.

6. AI-Generated Content

The Service uses artificial intelligence to assist in content generation (e.g., writing captions, suggesting layouts, generating hooks). AI-generated content is provided as a starting point and may require review and editing. You are solely responsible for reviewing, editing, and approving all content before publishing. ViralFarm does not guarantee the accuracy, originality, or suitability of AI-generated content.

7. Subscriptions & Payments

7.1 Free Tier

ViralFarm offers a free tier with limited features and usage. Free-tier users are subject to the same Terms.

7.2 Paid Plans

Paid subscriptions are billed on a recurring basis (monthly or annually) as specified at the time of purchase.
All fees are in U.S. dollars unless otherwise stated and are non-refundable except as required by applicable law.
Payments are processed securely by Stripe. We do not store your full payment card details.

7.3 Cancellation

You may cancel your subscription at any time from your account settings or by contacting support. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of that period.

7.4 Price Changes

We may change subscription prices with at least 30 days' advance notice. Price changes will apply at the start of your next billing period after the notice.

8. Intellectual Property

8.1 ViralFarm IP

The Service, including its software, design, templates, logos, and documentation, is owned by ViralFarm or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

8.2 Templates

Templates provided by ViralFarm are licensed for use within the Service. You may use them to create content for personal and commercial purposes, but you may not redistribute, resell, or sublicense the templates themselves.

9. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose.
Attempt to gain unauthorized access to the Service, other accounts, or related systems.
Interfere with or disrupt the Service or its infrastructure.
Use automated tools (bots, scrapers) to access the Service except through our official APIs.
Impersonate any person or entity.
Use the Service to send spam or unsolicited communications.
Circumvent any rate limits, usage quotas, or technical restrictions.
Use data obtained from social media platforms through the Service for surveillance, unauthorized profiling, or any purpose inconsistent with the respective platform's terms.

10. Third-Party Services

The Service integrates with third-party platforms and services (social media networks, payment processors, AI providers, hosting services). Your use of those services is governed by their respective terms and privacy policies. ViralFarm is not responsible for the availability, accuracy, or practices of third-party services.

By using our YouTube integration, you agree to be bound by the YouTube Terms of Service and the Google Privacy Policy. ViralFarm's use and transfer of information received from Google APIs to any other app will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Service will be uninterrupted, error-free, or secure.
Content published through the Service will be successfully delivered to or accepted by any social media platform.
AI-generated content will be accurate, complete, or free from bias.
Scheduled posts will be published at the exact specified time (publishing depends on third-party platform availability).

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRALFARM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

13. Indemnification

You agree to indemnify, defend, and hold harmless ViralFarm and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any third-party rights, including social media platform terms.

14. Termination

By You: You may close your account at any time from your account settings or by contacting support. Upon deletion, your data will be removed in accordance with our Privacy Policy.
By Us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. We will provide notice where reasonably possible.
Effect of Termination: Upon termination, your right to use the Service ceases. Sections that by their nature should survive (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive termination.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, unless you opt out within 30 days of first using the Service by emailing myviral.farm@gmail.com. You and ViralFarm agree that any dispute resolution will be conducted on an individual basis and not in a class, consolidated, or representative action.

For claims not subject to arbitration, the exclusive jurisdiction and venue shall be the state and federal courts located in San Francisco County, California.

16. Changes to These Terms

We may revise these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page, updating the "Last Updated" date, and (for significant changes) notifying you by email or in-app notification at least 15 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

17. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ViralFarm regarding the Service.
Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
Force Majeure: ViralFarm is not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, acts of government, pandemics, or third-party service outages.
