Terms of Service — ViralFarm

These Terms of Service ("Terms") govern your access to and use of the ViralFarm website at myviral.farm and all related services, tools, and APIs (collectively, the "Service") provided by Annie Yang, doing business as MyViral.Farm ("ViralFarm," "we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

You may register using Google OAuth or email/password.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must provide accurate, current, and complete information and keep it updated.
You must notify us immediately at hi@myviral.farm if you suspect unauthorized access to your account.
We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

3. The Service

ViralFarm provides tools for:

Creating visual content (carousels, slideshows, pins, quote cards, infographics, and more) using AI assistance and customizable templates.
Exporting content as images, PDFs, or video.
Scheduling and publishing content to connected third-party social media platforms (including Instagram, Facebook, Threads, LinkedIn, TikTok, Pinterest, X, and YouTube) via third-party APIs.
Connecting Shopify stores to import product listings (title, description, images, price, inventory status) via the Shopify Admin API so you can turn them into social posts, carousels, and scheduled content.
Letting AI assistants and agents — including Anthropic's Claude, OpenAI's ChatGPT, Muse, Cursor, and other clients that support the Model Context Protocol (MCP) or our REST API — generate, upload, schedule, and publish content on your behalf through the ViralFarm MCP server and API.

We may modify, update, or discontinue features of the Service at any time. We will make reasonable efforts to notify you of material changes.

4. Connected Third-Party Accounts

4.1 Authorization

When you connect a third-party social media or commerce account (including Shopify) to the Service, you authorize ViralFarm to access that account on your behalf to publish content, schedule posts, read product listings, and perform other actions as you direct. You grant ViralFarm only the permissions necessary to provide these features, and you represent that you are authorized to grant that access (for example, that you are the store owner or an authorized staff member of any Shopify store you connect).

4.2 Platform Compliance

You are responsible for ensuring that any content you create, schedule, or publish through the Service, and any use of product data you import from Shopify, complies with the terms of service, community guidelines, content policies, and merchant rules of each third-party platform. ViralFarm is not responsible for content you publish or for any actions taken by platforms against your account or store.

4.3 Revoking Access

You may disconnect any social media account at any time from your ViralFarm account settings. You may also revoke access from the third-party platform's own settings. For Shopify, you may uninstall the ViralFarm app from your Shopify admin at any time (Settings → Apps and sales channels → ViralFarm → Uninstall); Shopify will send us an app/uninstalled webhook and we will revoke and delete the associated OAuth token immediately and purge cached shop and product data within 48 hours. Upon disconnection of any third-party account, the stored OAuth tokens for that account are erased from our database immediately.

4.4 Platform Data Use

Data obtained from third-party platforms is used solely to provide the Service (publishing and scheduling content you create, and generating social content from product listings you import). We do not use platform data for advertising, data mining, user profiling, building competing products or services, or any purpose unrelated to providing the Service. We never combine data across users. Within your own account, data you import from one platform — for example product listings from Shopify or the content of a page you link — is used, at your direction, to create content that you publish to the platforms you choose, including through an authorized AI assistant. We do not use platform data to develop functionality that competes with the originating platform, and our use of each platform's data complies with its developer terms and API policies. We do not receive or store content from TikTok (videos, comments, follower lists); we retain only your TikTok profile identifiers, the token needed to publish, and the status of posts we publish. Videos you create or upload in ViralFarm are your workspace content and are retained as described in our Privacy Policy.

4.5 Shopify Integration

ViralFarm's Shopify integration is operated under the Shopify Partner Program and, where listed, the Shopify App Store. By connecting a Shopify store you additionally agree that:

Your use of ViralFarm via Shopify is subject to the Shopify Terms of Service, the Shopify API Terms of Service, and (where applicable) the Shopify Partner Program Agreement.
We request only the scopes necessary to read product listings (for example read_products and read_product_listings). We do not request orders, customers, checkout, fulfillment, or payment scopes, and we do not access Shopify Protected Customer Data.
We honor Shopify's mandatory compliance webhooks (customers/data_request, customers/redact, shop/redact) and verify all incoming webhooks using HMAC signatures.
Product data imported from your store remains yours. You are responsible for ensuring you have the rights to use product images, copy, and other assets in the social content you publish.
If you install ViralFarm from the Shopify App Store, all charges for the app are processed exclusively through Shopify's Billing API and appear on your Shopify invoice. Stripe, which handles subscriptions for users who sign up directly at myviral.farm, is not used for Shopify-installed merchants.
You may upgrade, downgrade, or cancel your Shopify plan at any time from the Billing page inside the app, without reinstalling or contacting support. Cancellations are prorated by Shopify.

4.6 AI Assistants, Agents & API Access

You may use ViralFarm through third-party AI assistants and agents ("Assistants") — including Anthropic's Claude, OpenAI's ChatGPT, Muse, Cursor, and other clients that support the Model Context Protocol (MCP) or our REST API — by authorizing the Assistant through our OAuth flow or with a ViralFarm API key.

What an authorized Assistant can do. Our connector exposes a fixed set of actions, all scoped to your account:

Read: your profile and plan status, connected social accounts, available templates and media packs, your generated posts (drafts) and their status, and your scheduled and published posts.
Create and upload: generate new posts from a topic, link, or text; upload images or videos; create media collections and add media to them.
Schedule and publish: schedule a post for a future time or publish it immediately to the connected accounts you name, including choosing platform options such as live vs. drafts where the platform supports them; retry a failed post.
Cancel: cancel a scheduled post that has not yet published.

An Assistant cannot delete generated posts or saved media, disconnect social accounts, change your account settings, or start, change, or cancel a subscription. Plans are purchased and managed only at myviral.farm.

Your responsibility. Every request an Assistant sends is treated as your instruction, made under your authorization. Some Assistants take several steps on their own once instructed; publishing is final on the destination platform once it has accepted the post, and ViralFarm cannot recall it. You are responsible for what you ask an Assistant to do, for reviewing what it produces, and for the content it publishes to your accounts. Generations requested through an Assistant consume the same AI credits and are subject to the same plan limits as the web app.

Disconnecting an Assistant. There are two different steps. Removing the ViralFarm connector inside an Assistant stops that Assistant from using the connection, but it does not invalidate the ViralFarm API key that was issued to it: ViralFarm does not offer a token-revocation endpoint to clients, so the key stays valid until you revoke it. Revoking the key in ViralFarm (Settings → API Keys) invalidates it server-side and stops all future requests from it immediately, whichever client holds it. To fully disconnect an Assistant, do both. Neither step cancels posts the Assistant already scheduled: those remain in your queue and will publish at their scheduled times unless you cancel them in ViralFarm (or ask the Assistant to cancel them before disconnecting). This is different from:

Disconnecting a social account (Section 4.3), which cancels scheduled posts that targeted only that account and removes the account from posts that also target others; and
Cancelling your subscription (Section 7.3), after which scheduled posts are not published while the subscription is inactive. Each post is marked failed with a notice when its time comes. After you resubscribe, you retry those posts manually from your queue (or ask an Assistant to retry them); they do not resume automatically.

Keys and providers. Keep API keys secret; a key grants the actions above for your account, and you should revoke any key you believe is compromised. We may revoke or rate-limit access that is abusive, exceeds usage quotas, or violates these Terms. Assistant providers are independent of ViralFarm: your use of an Assistant is governed by that provider's own terms and privacy policy, and we are not responsible for the Assistant's behavior, availability, or how it handles your conversation. You may not use the API to build a competing service, resell access, circumvent plan limits, or automate account creation. We record which interface (web app or a named Assistant client) created each post.

5. User Content

5.1 Ownership

You retain all ownership rights to content you create or upload through the Service ("User Content"). ViralFarm does not claim ownership of your User Content.

5.2 License to ViralFarm

By using the Service, you grant ViralFarm a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and transmit your User Content solely for the purpose of providing the Service (e.g., rendering previews, exporting files, publishing to social platforms). This license terminates when you delete your content or your account.

5.3 Prohibited Content

You agree not to create, upload, or publish content that:

Violates any applicable law or regulation.
Infringes the intellectual property, privacy, or other rights of any third party.
Contains malware, viruses, or harmful code.
Is fraudulent, deceptive, or misleading.
Promotes violence, discrimination, harassment, or hate speech.
Contains sexually explicit material involving minors.
Violates the content policies of any connected social media platform.

We reserve the right to remove content that violates these Terms and to suspend or terminate accounts that repeatedly violate them.

6. AI-Generated Content

The Service uses artificial intelligence to assist in content generation (e.g., writing captions, suggesting layouts, generating hooks). AI-generated content is provided as a starting point and may require review and editing. You are solely responsible for reviewing, editing, and approving all content before publishing. ViralFarm does not guarantee the accuracy, originality, or suitability of AI-generated content.

Post copy is generated by large language models from Anthropic and OpenAI, and images may be sourced from stock providers (Pexels, Unsplash) or from pages you link. Generated content can be inaccurate, incomplete, or unsuitable for your audience, and stock images are subject to their providers' licenses. You must review generated content before publishing — including content generated through an AI assistant — and you are solely responsible for what you publish. ViralFarm does not claim ownership of content generated for you, and does not use your content or generations to train AI models.

7. Subscriptions & Payments

7.1 Free Trial

ViralFarm does not offer an ongoing free plan. New accounts start with a 7-day free trial of a paid plan, which requires a payment method. One trial is available per customer. During the trial you can use the Service with the credits granted at sign-up; the plan's full monthly credit allowance is added when the first paid invoice succeeds.

Expiration and billing: When the trial ends, your subscription converts to the paid plan automatically and your payment method is charged the plan price. You may also convert early from your account settings, which charges the plan price immediately and starts your billing period that day.
Cancelling during the trial: Cancel from your account settings before the trial ends and you will not be charged. Access to paid features ends when the trial period ends.
After the trial: Without an active subscription, publishing is paused: any scheduled post that comes due is marked failed with a notice, and after you resubscribe you retry it manually from your queue — posts do not resume automatically (Section 4.6). The web app also stops new generations; API and assistant generations continue only while you have remaining credits. Accounts created before trials were introduced may retain limited access at our discretion.

7.2 Paid Plans

Paid subscriptions are billed on a recurring basis (monthly or annually) as specified at the time of purchase.
All fees are in U.S. dollars unless otherwise stated and are non-refundable except as required by applicable law.
Payments are processed securely by Stripe. We do not store your full payment card details.

7.3 Cancellation

You may cancel your subscription at any time from your account settings or by contacting support. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of that period.

7.4 Price Changes

We may change subscription prices with at least 30 days' advance notice. Price changes will apply at the start of your next billing period after the notice.

7.5 AI Credits

Paid plans include a monthly allowance of AI generation credits. Credits are reset to your plan's allowance on each paid invoice; unused credits do not roll over, have no cash value, and are non-transferable.
Credits are consumed when content is generated, whether from the web app or through an AI assistant. Generations that fail because of a ViralFarm error are not charged.

8. Intellectual Property

8.1 ViralFarm IP

The Service, including its software, design, templates, logos, and documentation, is owned by ViralFarm or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

8.2 Templates

Templates provided by ViralFarm are licensed for use within the Service. You may use them to create content for personal and commercial purposes, but you may not redistribute, resell, or sublicense the templates themselves.

9. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose.
Attempt to gain unauthorized access to the Service, other accounts, or related systems.
Interfere with or disrupt the Service or its infrastructure.
Use automated tools (bots, scrapers) to access the Service except through our official APIs.
Impersonate any person or entity.
Use the Service to send spam or unsolicited communications.
Circumvent any rate limits, usage quotas, or technical restrictions.
Use the Service, the API, or an AI assistant connected to it to publish spam, coordinated inauthentic content, or content that violates a destination platform's policies, or to operate accounts you are not authorized to control.
Use data obtained from social media platforms through the Service for surveillance, unauthorized profiling, or any purpose inconsistent with the respective platform's terms.

10. Third-Party Services

The Service integrates with third-party platforms and services (social media networks, payment processors, AI providers, hosting services). Your use of those services is governed by their respective terms and privacy policies. ViralFarm is not responsible for the availability, accuracy, or practices of third-party services.

By using our YouTube integration, you agree to be bound by the YouTube Terms of Service and the Google Privacy Policy. ViralFarm's use and transfer of information received from Google APIs to any other app will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

By using our Shopify integration, you agree to be bound by the Shopify Terms of Service, the Shopify API Terms of Service, and the Shopify Privacy Policy. ViralFarm's use of Shopify data complies with the Shopify App Store requirements and the Protected Customer Data requirements.

By connecting ViralFarm to an AI assistant, you also agree to that provider's terms, for example the Anthropic Consumer Terms (Claude), the OpenAI Terms of Use (ChatGPT), or Muse's terms. ViralFarm's MCP server and API are provided as an integration surface for those products; the assistant itself is not part of the Service.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Service will be uninterrupted, error-free, or secure.
Content published through the Service will be successfully delivered to or accepted by any social media platform.
AI-generated content will be accurate, complete, or free from bias.
Scheduled posts will be published at the exact specified time (publishing depends on third-party platform availability).
An AI assistant connected to the Service will interpret your instructions correctly, or will limit itself to the actions you intended.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRALFARM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

13. Indemnification

You agree to indemnify, defend, and hold harmless ViralFarm and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any third-party rights, including social media platform terms.

14. Termination

By You: You may close your account at any time by emailing hi@myviral.farm from your account address. Upon deletion, your data will be removed in accordance with our Privacy Policy.
By Us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. We will provide notice where reasonably possible.
Effect of Termination: Upon termination, your right to use the Service ceases. Sections that by their nature should survive (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive termination.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, unless you opt out within 30 days of first using the Service by emailing hi@myviral.farm. You and ViralFarm agree that any dispute resolution will be conducted on an individual basis and not in a class, consolidated, or representative action.

For claims not subject to arbitration, the exclusive jurisdiction and venue shall be the state and federal courts located in San Francisco County, California.

16. Changes to These Terms

We may revise these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page, updating the "Last Updated" date, and (for significant changes) notifying you by email or in-app notification at least 15 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

17. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ViralFarm regarding the Service.
Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
Force Majeure: ViralFarm is not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, acts of government, pandemics, or third-party service outages.
